Eoflow Wins Expanded Stay of Injunction in Insulet Lawsuit at U.S. Court of Appeals, Enabling Sales in Five Countries Including South Korea

Eoflow announced in a regulatory filing on the 23rd that the U.S. Court of Appeals for the Federal Circuit has issued a decision expanding the geographic scope of a partial stay on an existing permanent injunction, in connection with a trade secret and patent infringement lawsuit filed by Insulet Corporation.

Following this decision, Eoflow is now fully permitted to sell its products not only to existing customers but also to new customers within the affected regions.

According to the company, the U.S. Court of Appeals for the Federal Circuit expanded the scope of the partial stay on Items 6 and 7 of the district court's permanent injunction dated April 24, 2025, to cover activities occurring in South Korea, the European Union (EU), Qatar, Saudi Arabia, and the United Arab Emirates (UAE).

  • In making this decision, the appellate court comprehensively considered the following four factors:
  • The likelihood of the applicant's success on the merits
  • Irreparable harm in the absence of a stay
  • Whether the parties would suffer substantial harm
  • The public interest

Meanwhile, the ruling date for this decision is June 22, 2026, and Eoflow officially confirmed this on the 23rd. However, the company added that if a retrial is permitted in the future, Insulet may file a motion to revoke this stay decision.
